Creating a Probate Estate Is the First Step in a Wrongful Death Action
Under Illinois law, a wrongful death action must be initiated by a special representative of the deceased person's estate. Before this can happen, however, a special representative must be appointed by the court. With this in mind, the first step in filing a wrongful death claim is creating a probate estate to control the assets and debts of the deceased person. Creating a probate estate allows the court to review the decedent's will—if there is one—and determine if the decedent appointed anyone to serve as his or her executor. The special representative does not necessarily need to be the same person as the executor, but in practice, the executor is likely to be appointed as special representative.
